BYLAW - Appoint Acting Head of Council - 20120717 - 544812THE CORPORATION OF THE TOWN OF AURORA By-law Number 5448-12 BEING A BY-LAW to establish a protocol for the appointment of an Acting Head of Council (Acting Deputy Mayor). WHEREAS section 242 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that a municipality may, by by-law or resolution, appoint a member of the Council to act in the place of the Head of Council or other member of Council designated to preside at meetings in the municipality's procedure by-law when the Head of Council or designated member is absent, or refuses to act, or the office is vacant, and while so acting such member has all the powers and duties of the head of council or designated member, as the case may be; AND WHEREAS pursuant to section 4.5 of By-law Number 5330-11, the Council Member who received the highest number of votes in the last regular election shall be the Deputy Mayor, to act in the place and stead of the Mayor when the Mayor is absent from the municipality, or is absent through illness, or refuses to act, or the office is vacant, and while so acting the Deputy Mayor shall have all of the duties, rights, powers and authority of the Mayor during such absence, refusal to act, or vacancy of office; AND WHEREAS there may occur such circumstances where the Mayor and the Deputy Mayor are both unavailable to act as the Head of Council due to the aforesaid persons being absent, or refusing to act, or the office is vacant; AND WHEREAS the Council of The Corporation of the Town of Aurora deems it necessary and expedient to appoint an Acting Head of Council (Acting Deputy Mayor) as may be required from time to time; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF AURORA ENACTS AS FOLLOWS: THAT the Councillor who received the second highest number of votes in the last regular election shall be appointed as the Acting Deputy Mayor to act in the place and stead of the Mayor and the Deputy Mayor when the Mayor and the Deputy Mayor are both absent from the municipality, or are both absent through illness, or both refuse to act, or the Office of the Mayor is vacant, and while so acting the Acting Deputy Mayor shall have all of the duties, rights, powers, and authority of the Mayor during such absence, refusal to act, or vacancy of the Office of the Mayor. 2. THAT By-law Number 5058-08.0 be and is hereby repealed. 3. THAT this By-law shall take full force and effect on the date of final passage hereof.
