BYLAW - ZBA 2197616 Ontario Inc Genview II - 20120626 - 542412THE CORPORATION OF THE TOWN OF AURORA By-law Number 5424 -12 BEING A BY-LAW to amend Zoning By-law Number 2213-78, as amended (2197616 Ontario Inc. - Genview ll). WHEREAS section 34 of the Planning Act, R.S.O. 1990, c. P.13, as amended, provides that the councils of local municipalities may pass zoning by-laws; AND WHEREAS the Council of The Corporation of the Town of Aurora (hereinafter the "Town") enacted By-law Number 2213-78, including amendments thereto (hereinafter the "Zoning By-law"); AND WHEREAS the Council of the Town deems it necessary and expedient to further amend the Zoning By-law; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF AURORA HEREBY ENACTS AS FOLLOWS: 1. THAT the Zoning By-law be and is hereby amended to replace a portion of the "Oak Ridges Moraine Rural (RU-ORM) Zone" zoning category applying to the lands shown in hatching on Schedule "A" attached hereto and forming part of this By-law with "Detached Dwelling Second Density Residential Holding (H)R2-90 Exception Zone", "Major Open Space (0-9) Exception Zone" and "Environmental Protection (EP-6) Exception Zone". 2. THAT the Zoning By-law be and is hereby amended to add the following: "11.92 Detached Dwelling Second Density Residential (R2-90) Exception Zone 11.92.1 Uses Permitted In accordance with Section 11.1 hereof. 11.92.2 Zone Requirements 11.92.2.1 Lot Specifications In accordance with Section 11.2.1 hereof. 11.92.2.2 Siting Specifications In accordance with Section 11.2.2 with the exception that the Exterior Side Yard (minimum) shall be 4.5 metres. 11.92.2.3 Building Specifications In accordance with Section 11.2.3 with the exception that the Lot Coverage (maximum) shall be 40.0 percent. 11.92.2.4 Holding Symbol Notwithstanding any provision to the contrary, while the "(H)" Holding symbol is in place, no person shall within the lands zoned (H)R2-90 on Schedule "A", use any lot or erect, alter or use any buildings or structures for any purpose except for those uses which existed on the date of passing this by-law. By-law 5424-12 Page 2 of 3 Removal of Holding Symbol Prior to the passing of a by-law to remove the "(H)" Holding symbol from the lands zoned (H)R2-90 on Schedule "A", or any part thereof, the Town of Aurora shall be satisfied that the following condition has been met: (i) written confirmation and/or clearance from the Ontario Ministry of Natural Resources advising that the requirements of the Endangered Species Act, 2007, S.O. 2007, c.6, as amended or successor thereto respecting the species at risk identified on the lands on Schedule "A" have been satisfied. Upon removal of the "(H)" Holding symbol from the lands on Schedule "A" zoned (H)R2-90 pursuant to Section 36 of the Planning Act, R.S.O. 1990, c. P.13, as amended or successor thereto, the provisions applicable to the said lands shall be as set out in By-law Number 2213-78 and By-law Number 5424-12. 31.6 MAJOR OPEN SPACE (0-9) EXCEPTION ZONE The provisions of Section 31.6 shall apply to the lands on Schedule "A". 30.3.7 ENVIRONMENTAL PROTECTION (EP-6) EXCEPTION ZONE The provisions of Section 30.3.7 shall apply to the lands on Schedule "A". 3. THAT all other terms, provisions, and existing amendments of the Zoning By- law remain the same. 4. THAT this By-law shall come into full force subject to compliance with the provisions of the Planning Act, R.S.O. 1990, c. P. 13, as amended, and subject to compliance with such provisions, this By-law will take effect from the date of final passage thereof. READ A FIRST AND SECOND TIME THIS 26TH DAY OF JUNE, 2012. READ A THIRD TIME AND FINALLY PASSED THIS 26TH DAY OF JUNE, 2012. as to Form q egal.Services srgh.emr By-law 5424-12 Page 3 of 3 Explanatory Note Re: Zoning By-law Number 5424-12 By-law Number 5424-12 has the following purpose and effect: To amend By-law Number 2213-78, as amended, being the Zoning By-law in effect in the Town of Aurora, to rezone the subject lands from "Oak Ridges Moraine Rural (RU-ORM) Zone" to "Detached Dwelling Second Density Residential Holding (H)R2- 90 Exception Zone", "Major Open Space (0-9) Exception Zone" and "Environmental Protection (EP-6) Exception Zone. The effect of this zoning amendment will permit a residential plan of subdivision consisting of single detached dwellings, a stormwater management pond and open space lands that will be conveyed to the Town. The removal of the "(H)" Holding symbol on the lands zoned "Detached Dwelling Second Density Residential Holding (H)R2-90 Exception Zone" is conditional upon the Town's receipt of confirmation from the Ontario Ministry of Natural Resources that the requirements of the Endangered Species Act, respecting the identified species at risk on the subject lands have been satisfied.
