BEING A BY-LAW to amend By-law
Number 5096-08.H; to appoint an
official responsible for Town contact
and staff direction in the absence of
the Chief Administrative Officer.
WHEREAS section 229 of the Municipal Act, 2001, S.O. 2001, c.25, as amended
(the "Act"), states that a municipality may appoint a chief administrative officer who
shall be responsible for, (a) exercising general control and management of the
affairs of the municipality for the purpose of ensuring the efficient and effective
operation of the municipality; and (b) performing such other duties as are assigned
by the municipality;
AND WHEREAS the Council of The Corporation of the Town of Aurora (the
"Town") enacted By-law Number 5096-08.1-1 on December 9, 2008, to appoint Neil
Garbe as Chief Administrative Officer and to set out the duties and responsibilities.

AND WHEREAS the Council of the Town deems it necessary and expedient to
amend By-law. Number 5096-08.H, to appoint an official responsible for Town
contact and staff direction in the absence of the Chief Administrative Officer;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN
OF AURORA ENACTS AS FOLLOWS:
1. THAT By-law Number 5096-08.H be and is hereby amended by deleting
section 4 therein and inserting the following:
'A. THAT, if the Chief Administrative Officer is absent from duty, on
vacation or through illness, the Chief Administrative Officer shall appoint,
subject to availability, either of the Director of Building & By-law Services, the
Director of Corporate & Financial ,Services, the Director of Customer &
Legislative Services/Town Clerk, the Director of Infrastructure &
Environmental Services, the Director of Legal Services/Town Solicitor, the
Director of Parks & Recreation Services or the Director of Planning &
Development Services to be the responsible official for Town contact and staff
direction, and should such absence exceed three weeks, the Council may
appoint an Acting Chief Administrative Officer who shall have all the powers,.
duties and responsibilities of the Chief Administrative Officer under this by-law."
2. THAT By-law Number 5194-09 be and is hereby repealed.
3. THAT this By-law shall come into full force and effect on the date of final
passage hereof.
