BYLAW - ZBA Remove H 15933 Bayview Ave - 20111011 - 536611THE CORPORATION OF THE TOWN OF AURORA By-law Number 5366-11 BEING A BY-LAW to amend Zoning By-law Number 2213-78, as amended, to remove a Holding "(H)" Symbol (15933 Bayview Avenue) WHEREAS the Council of The Corporation of the Town of Aurora (hereinafter the "Town") enacted By-law Number 2213-78, including amendments thereto (hereinafter the "Zoning By-law"); AND WHEREAS section 36 of the of the Planning Act, R.S.O. 1990, c. P.13, as amended (hereinafter the "Acf') provides that the councils of local municipalities may, in a by-law passed under section 34 of the Act, by the use of the holding symbol "H" in conjunction with any use designation, specify the use to which lands, buildings or structures may be put at such time in the future as the holding symbol is removed by amendments to the Zoning By-law; AND WHEREAS the Town's Official Plan contains provisions relating to the use of holding symbols; AND WHEREAS the Council of the Town enacted By-law Number 5184-09 to amend the Zoning By-law to include a Holding "(H)" symbol over a portion of the lands described therein; AND WHEREAS the Council of the Town enacted By-law Number 5310-11, which amended the Zoning By-lawto replace the "Rural (RU) Zone" zoning category applying to a portion of the lands known as 15933 Bayview Avenue with "Local Commercial (C1- 5) Exception Zone"; AND WHEREAS the conditions for the removal of the Holding "(H)" symbol respecting the "Row Dwelling Residential Holding (H) R6-56 Exception Zone", the "Row Dwelling Residential Holding (H) R6-57 Exception Zone", and the "Semi -Detached and Duplex Dwelling Third Density Residential Holding (H) R3-19 Exception Zone" as set out in By- law Number 5184-09 have been met; AND WHEREAS the Council of the Town deems it necessary and expedient to further amend By-law Number 5184-09 with the terms and provisions set out below; AND WHEREAS notice of intention to pass this By-law has been provided; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF AURORA HEREBY ENACTS AS FOLLOWS: THAT By-law Number 5184-09 be and is hereby amended to remove the Holding "(H)" symbol preceding the "Row Dwelling Residential Holding (H) R6-56 Exception Zone", "Row Dwelling Residential Holding (H) R6-57 Exception Zone", and "Semi -Detached and Duplex Dwelling Third Density Residential Holding (H) R3-19 Exception Zone" on a portion of the lands as shown on Schedule "A" attached hereto and forming part of this By-law. 2. THAT all other terms, provisions, and existing amendments of the Zoning By-law and By-law Number 5184-09 remain the same and are hereby reaffirmed. By-law Number 5366-11 Page 2 of 3 3. THAT this By-law shall come into full force subject to compliance with the provisions of the Act, and subject to such provisions, this By-law will take effect from the date of final passage hereof. The rezoning will permit the development of 134 condominium townhouse units and 20 semi-detached freehold units.
