MINUTES - Special Council - 20041124 TOWN OF AURORA SPECIAL COUNCIL – PUBLIC PLANNING MEETING MINUTES NO. 04-036 Council Chambers Aurora Town Hall Wednesday, November 24, 2004 ATTENDANCE COUNCIL MEMBERS Mayor Jones in the Chair; Councillors Buck, Gaertner, Kean, Morris, Vrancic and Wallace MEMBERS ABSENT Councillor Hogg was absent. Councillor West on vacation. OTHER ATTENDEES Director of Planning, Planning Technician, Administrative Co-ordinator/Deputy Clerk, and Council/Committee Secretary. The Mayor called the meeting to order at 7:00 p.m. I DECLARATIONS OF PECUNIARY INTEREST There were no declarations of pecuniary interest under the Municipal Conflict of Interest Act. II APPROVAL OF AGENDA Moved by Councillor Morris Seconded by Councillor Kean THAT the content of the Agenda as circulated by the Corporate Services Department be approved as presented. CARRIED III PLANNING APPLICATIONS Mayor Jones outlined the procedures that would be followed in the conduct of the public meeting. The Deputy Clerk confirmed that appropriate notice had been given and that signs had been posted on the subject properties in accordance with the relevant provisions of the Planning Act. PL04-127 - Zoning By-law Amendment Application Timothy Parker Boland Lot 65, Plan 246 14996 Yonge Street File D14-11-04 Planning Staff The Planning Technician provided a description of the application and reviewed the location of the property and current uses of subject and surrounding lands. The Planning Technician advised that, subsequent to the drafting of the report, the Applicant has revised the application by removing the proposed rear addition from the plan, thereby complying with parking requirements for that property. The Planning Technician reviewed the new setbacks, measurements and other modifications to the application, for Council’s consideration. Applicant/Agent Mr. Richard Harrison advised that he is the Planning Consultant for the applicant, Mr. Brian Moore. Mr. Harrison advised that the applicant has made several modifications to the application to address any concerns with regard to parking, and advised that he is confident that all necessary planning requirements have been met. Mr. Harrison concluded by requesting that Council legalize the non- conforming aspects of the Zoning By-law to permit the proposed use for this site. Public Comments Mr. Jim Barron advised that he is an adjoining Land Owner, in relation to the subject lands. Mr. Barron advised that he is not in opposition of the application, however he expressed concern with respect to the number of parking spaces proposed for this application. Mr. Barron advised that the number of parking spaces designated for the property is adequate for the current proposal, however he suggested that, should the business expand, there will be inadequate parking available, which could lead to an additional strain on the existing parking shortage in the surrounding area. Mr. Barron encouraged Council to place some kind of restriction on the possible expansion of the proposed business within the conditions of the Zoning By-law Amendment. The public portion of the meeting closed at 7:20 p.m. and Council’s deliberations began. Moved by Councillor Morris Seconded by Councillor Vrancic THAT the Zoning By-law Amendment be approved subject to the resolution of any outstanding issues; and THAT approval of the Implementing Zoning By-law be subject to a satisfactory review of a site plan submission.
