The Deputy Clerk confirmed that appropriate notice had been given and that signs had been posted on the subject properties in accordance with the relevant provisions of the Planning Act. 1. PL03-086 - Official Plan Amendment, Rezoning and Subdivision Applications Janet Gardiner Part of Lot 85, Concession 1, E.Y.S. 65 St. John’s Sideroad Files D09-05-03, D14-22-03 and D12-03-3A; and Petition and Correspondence from Residents Planning Staff The Planner gave a description of the application and summarized the contents of the Planning Report No. PL03-086. The Planner advised that the subject lands are located on the south side of St. John's Sideroad and east of Yonge Street, municipally known as 65 St. John's Sideroad. The Planner identified the surrounding uses and the applicant's proposal to subdivide the subject lands into two residential blocks, two open space blocks and four blocks for reserves, in order to provide for the future development of 26 freehold townhouse units. The Planner advised that the current zoning does not permit the proposed use and outlined the concerns received by the other departments and concluded that given the amount and scope of outstanding issues it is recommended that staff report back once they have been able to work with the applicant and the community to obtain the best possible development on the subject lands. Applicant/Agent Mr. Brad Rogers, of the Forhan Rogers Group, representative for the applicant advised that the applications for the subject lands were submitted to the Town in April, 2003 along with a Biological Environmental Site Assessment, and that a consulting team was retained to focus and recognize the McKenzie Marsh and the protection of the natural environment in this area. Mr. Rogers pointed out that the Lake Simcoe Region Conservation Authority indicated that they are satisfied with the boundaries of the wetlands and that the applicant is willing to work with staff and the surrounding residents to resolve any of their concerns. PL03-087 - Zoning By-law Amendment Application Preserve Homes Corporation Part of Lot 21, Concession 2 E.Y.S. File D14-16-03 Planning Staff The Acting Manager of Planning and Development gave a description of the application and summarized the contents of the Planning Report No. PL03-087 advising that subject lands are located at the northeast corner of Bayview Avenue and Wellington Street East. The surrounding uses were outlined as well as the current zoning, and the applicant’s proposal to amend the zoning to accommodate a reduction in lot frontage for Parcel 1, realized by the applicant during calculation of the preliminary M-Plan for Lot 44 of draft approved subdivision D12-01-5A. The Acting Manager of Planning and Development also advised that for Parcel 2, the applicant’s proposal would ensure the completion of a single detached residential reserve block and residential townhouse reserve blocks created through draft plan D12-01-5A and to permit the completion of a landscaped buffer strip along the north side of Wellington Street East. It is therefore recommended that a site specific exception be granted for Parcel 1 and allow the Zoning By-law Amendment for the landscaped buffer for Parcel 2. Applicant/Agent Mr. Peter Russell of KML Planning Partners Inc., reiterated the comments made by the Acting Manager of Planning and Development and advised that the lot frontage of Parcel 1 is a little less land than they had anticipated at the draft plan stage and therefore asks that Council permit the Zoning By-law Amendment Applications for the subject lands. Public Comments Mr. Homer Farsad enquired whether the lands are visible along Wellington Street and what type of landscaping there will be. The public portion of the meeting closed at 9:15 p.m. and Council’s deliberations began. Moved by Councillor Griffith Seconded by Councillor Kean THAT staff work with the Applicant toward an implementing By-law under the direction of the Director of Planning and report back to Council. CARRIED 3. PL03-088 - Zoning By-law Amendment Application 1207309 Ontario Inc. & 690346 Ontario Inc. (Magna) Part of Lot 20, Concession 2 E.Y.S D14-19-03 Planning Staff The Acting Manager of Planning and Development gave a description of the application and summarized the contents of the Planning Report No. PL03-088 and advised that the subject lands are located south of Wellington Street East, west of Leslie Street. The Acting Manager of Planning and Development informed Council that the proposal would permit one detached dwelling per lot and the development of a ten (10) vacant land plan of condominium. He advised that there are a number of issues that must be resolved prior to implementing a Zoning By-law Amendment and therefore should be sent back to staff for further discussions with the applicant. Special Council – Public Planning Meeting No. 03-25 Page 5 of 5 Wednesday, September 10, 2003 Applicant/Agent Ms Phillips of MI Developments Inc., discussed some of the issues raised within the staff report PL03-088. Ms Phillips advised that the lot line shown running through the storm pond is not a lot line and will be removed from the plan. Ms Phillips also requested that staff assist with respect to R1 Zoning and R1-31 Zoning, and advise the applicant of the more appropriate zoning for the subject lands. Ms Phillips indicated that the Public Works comments can be resolved at the Draft Plan approval stage and advised that the Surveyor’s Certificate has now been submitted to the Building Department. Ms Phillips suggested that MI Developments Inc. could assist with the preparation of the Draft Plan of Subdivision should Town staff require some assistance in this regard. Public Comments Mr. Homer Farsad raised some concerns regarding allowing the representatives for the applicant to prepare the Draft Plan of Subdivision. The public portion of the meeting closed at 9:25 p.m. and Council’s deliberations began. Moved by Councillor Griffith Seconded by Councillor Wallace THAT staff work with the applicant toward a Zoning By-law Amendment and Draft Plan of Subdivision and bring the items back to Council.
