MINUTES - Special Council - 20021218 TOWN OF AURORA SPECIAL COUNCIL - PUBLIC PLANNING MEETING MINUTES NO. 02-31 Council Chambers Aurora Town Hall Wednesday, December 18, 2002 ATTENDANCE COUNCIL MEMBERS Mayor Jones in the Chair; Councillors Kean, MacEachern, Pedersen, Timpson, Vrancic, Wallace and West. Councillor Griffith was absent. STAFF MEMBERS Director of Corporate Services/Town Clerk, Director of Planning, Planners and Council/Committee Secretary. I DECLARATIONS OF INTEREST There were no declarations of pecuniary interest under the Municipal Conflict of Interest Act. II APPROVAL OF AGENDA Moved by Councillor Wallace Seconded by Councillor West THAT the content of the Agenda be approved as presented. CARRIED III PLANNING APPLICATIONS Mayor Jones outlined the procedures that would be followed in the conduct of the public meeting. The Town Clerk confirmed that appropriate notice had been given and that signs had been posted on the subject property in accordance with the relevant provisions of the Planning Act. 1. PL02-108 - Official Plan and Zoning By-law By-law Amendment Application Hannelore Lewis, Hannelore Voshage and Hannian Investments Lots 134, 135 and 136, Registered Plan 246 32 and 34 Wellington Street East and 33 Centre Street Files D09-04-02 and D14-13-02 Planning Staff The Planner presented details on the proposed application. The Planner gave a review of the report, noting that staff recommend reducing the number of parking Aurora Special Council – Public Planning Minutes No. 31-02 Page 2 Wednesday, December 18, 2002 spots in the front of the building from 4 to 3, with the addition of a turn around feature. The Planner advised that comments from the Region are still forthcoming and that the Aurora Historical Society and LACAC will review this application in the new year. Applicant Mr. Richard Harrison, Planning Consultant for Ian & Hannah and Lewis, informed that the applicant requests that Council consider reducing the number of parking spots, taking into consideration the existing parking available on Victoria Street and Wellington Street. He also advised that the applicant requests that the Official Plan Amendment be approved at this time and that the subject property not be Designated under the Ontario Heritage Act. Public Comments Monica Day of 54A Centre Street expressed concerns regarding the preservation of the mature trees along Centre Street and about the length of time and potential disruption which may be caused during construction of the proposed development and advised that she also has concerns about the potential increase of traffic on Centre Street. Robert Baumberger of 26 Centre Street indicated that he also has concerns regarding the preservation of the trees along Centre Street as well as potential noise caused by air conditioning units and garbage pick-ups. Mr. Baumberger inquired about the times of pick-up for the garbage. James Wood of 10 Spruce Street expressed concerns with regard to snow removal, potential traffic increase along Centre Street and he also suggested that the height of the proposed building would be more in keeping with the surrounding neighbourhood if it was a little bit lower. Don Stubbs of 58 Wellington Street advised that he is in full support of the proposed application and that he believes it would be a welcome addition to the community. The public portion of the meeting closed at 7:35 p.m. and Council’s deliberations began. Moved by Councillor West Seconded by Councillor Wallace THAT the Official Plan Amendment be presented to Council for approval; THAT the Implementing zoning by-law be given first and second reading, and that the third and final reading be completed in conjunction with the approval of the site plan; THAT servicing allocation be granted from the 200 units held for Core Area Infill; THAT the site plan address any outstanding issues, including provisions for the preservation of existing trees on the property, air conditioning units are within the Town’s standard for noise levels, the historical property is not be designated under the Ontario Heritage Act, and that the parking spaces be reduced in accordance with the applicants report; and THAT the site plan application be provided to LACAC and the Town’s Architectural Consultant for review and comments. PL02-110 - Zoning By-law Amendment Application Victor Priestly (Century Montessori School) Part of Lot 80, Concession I, E.Y.S. 669 Wellington Street East File Number D14-14-02 Planning Staff The Planner gave a brief description of the application and summarized the contents of the Planning Report No. PL02-110. The Planner outlined the history of the lands, described the current zoning that is permitted and advised that the Montessori School on these lands is under new ownership and that the request to extend the current use of the lands for three more years is fully supported by staff. Applicant The applicant was not in attendance to comment on the application. Public Comments There were no members of the public in attendance to comment on the application. The public portion of the meeting closed at 8:05 p.m. and Council’s deliberations began. Moved by Councillor Kean Seconded by Councillor Wallace THAT subject to the public input being received, Staff be directed to prepare an Implementing Zoning By-law to further extend the temporary use of the subject lands for the existing private school for a period of three years. CARRIED 3. PL02-111 - Zoning By-law Amendment Application Shell Canada Products Limited Part of Lot 20, Concession III Southeast corner of Leslie Street and Wellington Street East File Number D14-08-91 Planning Staff The Planner gave a brief description of the application and summarized the contents of the Planning Report No. PL02-111. The Planner outlined the history of the lands, described the current zoning that is permitted and advised of comments received from staff regarding the application that will be dealt with during site plan approval. In closing the Planner suggested that, should Council support the application that approval of the Implementing Zoning By-law should be scheduled together with the approval of the site plan, in order to ensure the resolution of all outstanding issues and to ensure the proposed development complies with the Implementing By-law. Applicant Helen Lepek, consultant on behalf of the applicant advised Council that the applicant is in support of staff’s recommendations and that the issues that have been raised will be resolved through the site plan process, and that traffic and acoustic conditions will be as required by staff. Moved by Councillor West Seconded by Councillor Timpson THAT approval of the implementing Zoning By-law be scheduled together with the approval of the site plan, in order to ensure the proposal is technically sound and complies with the proposed By-law, and to ensure that the issue of urban design has been addressed to the satisfaction of the Town of Aurora.
