MINUTES - Special Council - 20020228 TOWN OF AURORA SPECIAL COUNCIL - PUBLIC PLANNING MEETING MINUTES NO. 06-01 Wednesday, February 28, 2001 ATTENDANCE COUNCIL MEMBERS Mayor Jones in the Chair; Councillors West, Kean, Griffith, MacEachern, Pedersen, Timpson, Vrancic and Wallace. STAFF MEMBERS Deputy Town Clerk, Director of Planning, (2) Planner, Committee Secretary. Mayor Jones called the meeting to order at 7:00 p.m. I DECLARATIONS OF INTEREST There were no declarations of interest under the Municipal Conflict of Interest Act. II APPROVAL OF AGENDA Moved by Councillor Wallace Seconded by Councillor Timpson THAT the content of the Agenda be approved as presented. CARRIED III PLANNING APPLICATIONS Mayor Jones outlined the procedures that would be followed in the conduct of the public meeting. The Deputy Town Clerk confirmed that appropriate notice had been given and that signs had been posted on the subject properties in accordance with the relevant provisions of the Planning Act. Sue Seibert, the Director of Planning provided an overview of all three applications due to their similar location. Ms. Seibert outlined the background of that area as it is within the OPA 30 area, which was adopted by Council on March 7, 2000 and on August 11, 2000, OPA 30 was approved in part with modifications by the Council of the Region of York. The lands form part of the Bayview Northeast 2B Secondary Plan. On February 9, 2001 the OMB narrowed the extent of the current OPA 30 appeal to the lands adjacent to the “Provincially Significant East Aurora Wetland Complex”, resulting in the subject lands of these applications no longer being within the appeal area. Aurora Special Council – Public Planning Minutes No. 06-01 Page 2 Wednesday, February 28, 2001 There have been a number of studies done in the area over the last few years, such as the Master Servicing Study, Storm Water Management Study, and the Fiscal Impact Study. 1. PL01-018 - Zoning By-law Amendment Application Susan Blue North-east Corner of St. John's Sideroad and Bayview Avenue Part of Lot 26, Concession 2 EYS D14-07-00 Planning Staff The Planner, Mike Mallette outlined the purpose of the application and briefly summarized the contents of Planning Report No. PL01-018. Mr. Mallette explained that there are a number of issues to be resolved therefore staff is recommending that Council direct staff to continue to work with the applicant to resolve the various issues. Public Comments Comments were made by the following residents:  Peter Sziraky, Resident of 143 Downey Circle  Ron Campbell, Resident of 153 Downey Circle  Steve Reitter, Resident of 613 Lyman Blvd in Newmarket  Rhonda Gomes, Resident of 163 Downey Circle  Rick McNutt, Resident of 145 Downey Circle Concerns were raised regarding the lack of drawings to help visualize what the proposal will look like and if it’s possible to make it look more esthetically pleasing for the area. The increase in traffic flow and location of the entrance into this proposed commercial complex was raised, as well as the opinions of over saturation of commercial units in the area. Applicant/Agent Elizabeth Howson of Macaulay Shiomi Howson Ltd., Planner Consultant for the applicant, indicated they are willing to work with staff to resolve the many issues that have resulted from the circulation as well as the public’s comments. The traffic concerns and location of the entrance is identified as a major concern and they will be working with planning staff on this issue. The height of the building will be looked into further during the site plan process, as well as the aesthetics surrounding the proposed buildings. The applicant intends to build only when it is appropriate for the market, and intended growth of the surrounding area. The public portion of the meeting closed at 7:30 p.m. and Council’s deliberations began. Moved by Councillor West Seconded by Councillor Wallace THAT Council direct staff to continue to work with the applicant in respect of several issues and concerns that have arisen as a result of the circulation of the above noted Zoning By-law Amendment application D14- 07-00, regarding the North-east Corner of St. John's Sideroad and Bayview Avenue; and, THAT staff be directed to report further on the resolution of the issues and concerns including, but not limited to, the timing of infrastructure availability and the proposed changes to the Master Servicing Plan in regard to the proposed Zoning By-law Amendment, prior to Council finalizing its position respecting the application; and Aurora Special Council – Public Planning Minutes No. 06-01 Page 3 Wednesday, February 28, 2001 THAT staff be directed to bring a report back to a future Public Planning Meeting. CARRIED 2. PL01-023 - Zoning By-law Amendment and Draft Plan of Subdivision Applications Quakers' Lundy Farms St. John's Sideroad, east of Bayview Avenue Part of Lot 25, Concession 2 EYS D14-23-00 and D12-00-8A Planning Staff The Planner, David Loker, gave a brief description of the application and briefly summarized the contents of the Planning Report No. PL01-023. Mr. Loker indicated there are many outstanding issues, and that Staff are recommending that Council direct Staff to continue working with the applicant. Public Comments Comments were made from the following people:  Glyn Jones and Grace Jones, Residents of 929 St. Johns Sdrd E., the property directly to the east of the proposal. They stated they were unaware of this application until they received the Public Planning notice from the Town. Mr. Jones requested that any future planning of this area be communicated to them, as they are directly affected. Grace Jones inquired how close a subdivision can come to her property line.  Dan Revington, Resident of 48 Fleury Street expressed concern over the lack of water and suggested that the application not be excepted until the water issue is addressed. Applicant/Agent Elizabeth Howson of Macaulay Shiomi Howson Ltd., Planner Consultant for the applicant, indicated that this proposal is on a critical site for development in the area and effects other developments. Ms. Howson indicated that the applicant will work with staff to resolve outstanding issues and concerns. The public portion of the meeting closed at 8:00 p.m. and Council’s deliberations began. Moved by Councillor West Seconded by Councillor Pedersen THAT Council direct staff to continue to work with the applicant in respect of several technical details which have arisen as a result of the circulation of the above noted Zoning By-law Amendment application D14-23-00 and Draft Plan of Subdivision application D12-00-8A, regarding Part of Lot 25, Concession 2 EYS; and, THAT staff be directed to report further on the resolution of the technical issues, servicing constraints, Official Plan conformity issues and those outstanding responses from commenting agencies in regard to the proposed Zoning By-law Amendment and Draft Plan of Subdivision, prior to Council finalizing its position respecting the applications; and, THAT staff be directed to bring a report back to a future Public Planning Meeting. PL01-022 - Zoning By-law Amendment and Draft Plan of Subdivision Applications 761933 Ontario Ltd. Bayview Avenue, north of Wellington Street East Part of Lot 22, Concession 2 EYS D14-22-00 and D12-00-7A Planning Staff The Planner, David Loker, outlined the purpose of the application and briefly summarized the contents of Planning Report No. PL01-022. Mr. Loker indicated that there are many outstanding issues, and that Staff is recommending that Council direct Staff to continue working with the applicant. Public Comments Comments were made by the following residents:  Rhonda Gomes, Resident of 163 Downey Circle  Margaret Shearman, Resident of 15385 Bayview Avenue  Peter Sziraky, Resident of 143 Downey Circle  Chris Flannigan, Resident of 43 Ballymore Drive Concerns were raised regarding the proximity to the “buffer zone”. Questions were raised regarding planned parkettes, sidewalks, and ample parking. Ms. Shearman proposed that Council consider declaring the area a “herbicide and pesticide free zone”, as she has seen the adverse effects of pesticide use, particularly to humans and wildlife. Applicant/Agent Eric Sauleslesa from Bousfield Dale-Harris, Cutler & Smith Inc. Planner for the applicant indicated that the buffer zone at the east end of the property is currently scheduled at the OMB for May 7, 2001 to decide the extent of the buffer. The applicant intends to make adjustments to the plan and will work with staff to address the many concerns. He indicated each street will have sidewalks. He supports the staff report. The applicant has appealed the applications to the OMB in order to consolidate with the current appeal on the east of the property. Moved by Councillor West Seconded by Councillor Timpson THAT Council direct staff to continue to work with the applicant in respect of several technical details and concerns which have arisen as a result of the circulation of the above noted Zoning By-law Amendment Application D14-22-00 and Draft Plan of Subdivision Application D12-00-7A, regarding Part of Lot 22, Concession 2 EYS; and THAT staff be directed to report further on the resolution of the technical issues and concerns, servicing constraints, Ontario Municipal Board hearing on the appeal to OPA 30, Official Plan density, policy and land use conformity issues and those outstanding responses from commenting agencies in regard to the proposed Zoning By-law Amendment and Draft Plan of Subdivision, prior to Council finalising its position respecting the applications; and THAT staff be directed to bring a report back to a future Public Planning Meeting.
