SPECIAL COUNCIL - PUBLIC PLANNING MEETING
MINUTES
NO. 20-01
Tuesday, July 17, 2001
ATTENDANCE
COUNCIL MEMBERS Mayor Jones in the Chair; Councillors Griffith, Kean,
Pedersen, Timpson, Wallace and West.
Councillor Vrancic arrived at 6:45 p.m.
Councillor MacEachern was absent.
STAFF MEMBERS Director of Corporate Services/Town Clerk, Director of
Planning, Planner, Committee Secretary.
Mayor Jones called the meeting to order at 6:30 p.m.
I DECLARATIONS OF INTEREST
There were no declarations of pecuniary interest under the Municipal Conflict of
Interest Act.
II APPROVAL OF AGENDA
Moved by Councillor Griffith Seconded by Councillor Timpson
THAT the content of the Agenda be approved as presented.

III PLANNING APPLICATIONS
1. PL01-055 - Zoning By-law Amendment Application
Armadale Properties Limited (Highland Chevolds)
Part of Lot 84, Concession 1, E.Y.S.

Mayor Jones outlined the procedures that would be followed in the conduct of the
public meeting. The Town Clerk confirmed that appropriate notice had been
given and that signs had been posted on the subject properties in accordance
with the relevant provisions of the Planning Act.
Planning Staff
The Planner gave a brief description of the lands and it's surroundings, outlining
the type of land uses permitted and advised that the proposed use would be in
keeping with the Official Plan. A description was given as to where the proposed
restaurant, car wash and used car dealership would be located and the planner
expressed to Council that comments which have been received contain no

objections to this proposal. The Planner suggested that the outstanding issues
and concerns raised by the public can be dealt with during the implementing by-
law stage such as noise, parking and restricting the size of the proposed
restaurant. In conclusion the Planner expressed that staff supports the
application.
Public Comment
Mike Valentini, resident of 94 Old Yonge Street expressed his concerns
regarding the proposed restaurant possibly creating more traffic to the
neighbourhood and increased noise with the proposal of an additional car
dealership. Mr. Valentini has addressed the noise issue prior to the application
due to nighttime deliveries and indicated the recent planting of trees has helped
somewhat to reduce the noise level to the neighbouring properties but requests
that a wall be constructed. Mr. Valentini requested Council's careful consideration
in this matter.
Ben Kestein, resident of 90 Old Yonge Street, representing those who live in the
area raised his concerns regarding the car wash, noise, traffic and greater fire
hazard. Mr. Kestein feels there is no need for a restaurant, that at present, many
catering trucks enter the property and provide for their needs. Mr. Kestein feels
that this proposal would affect property values and this proposal deserves
Council's consideration.
Ian McNeal, resident of 28 Bucannan Crescent expressed concern with regard to
the information he has received regarding this proposal and expressed that some
discrepancies have arisen. Mr. McNeal is concerned that there have been no
restrictions put on the applicant regarding the type of restaurant and wonders
what would stop them from turning it into a fast food restaurant. Mr. McNeal also
requested clarification as to the type of car wash that currently exists on the
premises.
Applicant
Richard Harrison, Planning Consultant for Armadale Properties thanked Council
for consideration of this matter and expressed the intent to work with the
residents to resolve some of their concerns. Mr. Harrison advised that the
restaurant is the only function that does not currently exist on the property and
that the intended use is for a cafeteria for staff and customers of the car
dealership, and the applicant has no intent to turn it into a fast food restaurant.
Nighttime deliveries may be from Highland Chevolds, the applicant will look into it
and if possible, other arrangements will be made in this regard. Mr. Harrison
advised that the hours of operation are Monday to Friday 7:30 a.m. to 6:00 p.m.
and all repairs are done between those hours. It was noted that presently car
washes are done on the premises with power washers, however, moisture
damage has occurred because the existing building was not designed for such
use. Mr. Harrison advised that this car wash will not create any additional noise,
but in fact the noise level will be lessened with the proper installation of the
proposed car wash. Noise decibal ratings are not measured in this instance
since the blowers will be located 97 feet from the front and back of the building
and measurements are only taken when the blowers are 80 feet from the doors.
Mr. Harrison explained that the fire department has commented on the
application and did not have any concerns.
The public portion of the meeting closed at 6:55 p.m. and Council’s deliberations
began.

Moved by Councillor Timpson Seconded by Councillor Pedersen
Subject to the public input received and resolution of outstanding
concerns, that Staff be directed to prepare an implementing by-law, to
rezone the subject lands from “Service Commercial (C3-3) Exception
Zone” to “Service Commercial (C3) Zone (Urban),” to rectify some zone
boundary matters and to permit the following additional exceptions within
the C3-3 Zone: One additional automotive dealership with ancillary uses
including automotive rental, an automotive washing establishment and a
restaurant.
THAT the restaurant be restricted to cafeteria capacity.
