Mayor Jones called the meeting to order at 7:00 p.m. I DECLARATIONS OF INTEREST There were no declarations of interest under the Municipal Conflict of Interest Act. The Deputy Town Clerk confirmed that appropriate notice had been given and that signs had been posted on the subject properties in accordance with the relevant provisions of the Planning Act. 1. PL01-036 - Zoning By-law Amendment (pg. 1) 240 Kennedy Street West Leonard Lind West of Murray Street, north side of Kennedy Street D14-06-01 Planning Staff The Senior Planner outlined the purpose of the application and briefly summarized the contents of Planning Report No. PL01-036. Ms Henstock explained that several issues of concern have been raised and outside agencies comments and various studies are still required. Ms Henstock suggested that staff be permitted to further explore options with the applicant and report back on resolutions for the issues and concerns raised in regard the proposed Zoning By- law amendment, prior to Council finalizing its position respecting the application. Public Comments Robert Sherwood, resident, 207 Kennedy Street West, expressed concerns regarding the appearance of the proposed plan being incongruous to the existing atmosphere and historical ambiance of the area. Mr. Sherwood suggested that traffic would increase due to the proposed new homes and indicated that guest parking might be a problem if residents don't park in the provided garages, possibly resulting in congestion. Mr. Sherwood also expressed concerns with regard to the lack of a turning circle at the end of the proposed private road. Mr. Brad Rogers of Forhan Rogers, representing Sam and Jan Nardi, 248 Kennedy Street West, expressed several concerns on behalf of his clients. The concerns listed by Mr. Rogers included traffic congestion and close proximity of the proposed private road to his clients' property, suggesting that the road be widened, environmental concerns regarding the area being a flood zone for Tannery Creek and unstable conditions of the soil, due to a fill operation formerly occupying the area. Mr. Rogers suggested that various studies should be conducted including a vegetation inventory, visual impact study, functional acoustical report, soil condition study and investigation into a fence being installed for additional buffering and security. Ms. Judy Redford, representing residents of Anderson Place advised that a survey had been circulated among the Anderson Place residents with respect to various concerns with the proposed development. These concerns include the environmental impact of constructing the proposed structures in an environmentally sensitive area, run off into Tannery Creek, inconvenience to neighbouring residents and inappropriate soil conditions for construction to take place. Ms. Angela Daust, resident, 31 Tyler Street expressed concerns regarding the potential for granting approval to build in an environmentally protected and flood plain. Ms. Daust explained that her own home is on a similarly designated area which is also a flood plain and through years of renovation she has been denied several minor variance applications. She has been told by the Lake Simcoe Conservation Authority that an increase in the footprint of the house or the addition of any new buildings would not be permitted because lands of this nature are too sensitive and that the environmental ramifications of any alteration to the grounds would be too destructive. Ms. Daust expressed confusion and Aurora Special Council – Public Planning Minutes No. 11-01 Page 3 Wednesday, April 25, 2000 concern that this application is being considered and she questioned the process in approving such applications for individual home owners and with developers. Also noted were various other concerns relating to the possibility of altering a sensitive ecosystem and damaging the environment. Applicant/Agent Mr. Claudio Brutto of Brutto Consulting, representing the applicant, expressed the intent on behalf of his client, that all efforts are being made to address all of the issues and concerns noted so far and any new concerns raised at this meeting. Mr. Brutto indicated that his client resides on the lands in question and is making every effort and is working with the Town's landscape architect to maintain the aesthetic charm of the surrounding area, and not to encumber the neighbours or his own residence in planning the design of the four proposed homes. Mr. Brutto indicated that all of the studies and investigative initiatives recommended by concerned residents are either completed and available, or will be conducted, and that all environmental factors are fully recognized and will be resolved responsibly. Mr. Brutto explained that appropriate buffers will be incorporated into the design and that the hammer-head at the end of the road as outlined in the design was recommended by Captain/Fire Prevention Officer John Adema of the Town of Aurora and meets all safety and fire regulations and codes. Mr. Brutto closed by advising that his client would welcome the opportunity to meet with any concerned parties as well as continue to work with staff to resolve any issues of concern and work towards a favourable proposal. The public portion of the meeting closed at 7:40 p.m. and Council’s deliberations began. Moved by Councillor West Seconded by Councillor Timpson THAT the request for Zoning By-law Amendment application D14-06-01 regarding 240 Kennedy Street West be denied.
