MINUTES - Special Council - 19990225 TOWN OF AURORA SPECIAL COUNCIL - PUBLIC PLANNING MEETING NO. 07-99 Council Chambers Aurora Town Hall Thursday, February 25, 1999 7:30 p.m. ATTENDANCE COUNCIL MEMBERS Mayor Jones in the Chair; Councillors Griffith, Hartwell, Healy and Hinder. Councillor Hogg was absent. Councillors McKenzie and Morris were absent due to medical reasons. Councillor West was absent due to a prior commitment. STAFF MEMBERS Acting Chief Administrative Officer/Director of Corporate Services, Director of Planning, Planner, and Administrative Assistant. DECLARATIONS OF INTEREST There were no declarations of interest under the Municipal Conflict of Interest Act. APPROVAL OF AGENDA #151. Moved by Councillor Hartwell Seconded by Councillor Griffith THAT the content of the Agenda be approved as outlined herein. CARRIED Mayor Jones advised that this meeting had been called as a Public Meeting with respect to proposed Zoning By-law Amendment for Brookfield Homes Ltd., Part Lot 1, Plan 246, 2-24 Orchard Heights Boulevard, application number D14-01-99. The Public Meeting procedures and the opportunities available for persons to ask questions related to the items tabled for consideration were explained. Mayor Jones advised that any person who wished further notice of the passage of the proposed By- law under consideration could sign the information forms available. In addition, Mayor Jones advised that any concerns with the proposal must be expressed during the public meeting or in writing prior to the adoption by Council of any amendment in order to protect the right to appeal to either the Region of York or the Ontario Municipal Board. Names and addresses of speakers are required as a part of the record of the proceedings. M I N U T E S Special Council – Public Planning Minutes No. 07-99 Page 2 Thursday, February 25, 1999 The Clerk confirmed that the required Notice of Meeting for the application was given and that the necessary signs were posted on the property in accordance with the rules of procedure under the Planning Act. PLANNING APPLICATIONS PL99-014-050 - Zoning By-law Amendment Application Brookfield Homes Ltd., 2-24 Orchard Heights Boulevard St. Andrew's Village Part of Lot 1, R.P. 246 D14-01-99 Mr. Jim Kyle, Planner, provided a brief overview of the subject proposal including the location and applicable Official Plan and Zoning By-law designations. The Planner advised that the applicants had requested an amendment to Zoning By-law 2213-78 affecting the subject lands to change the permitted uses within the “Shopping Centre Commercial (C4-1) Exception Zone” to permit a “Commercial School” (Sylvan Learning Centre) which caters to elementary, secondary and adult aged students. The requested amendment would provide an increase in the maximum permitted floor area for a commercial school from 186 square metres (2002 sq.ft.) to 242 square metres (2600 sq.ft.) and would delete the restriction that states “commercial schools shall not include elementary schools”. Mr. Kyle indicated that the Centre was proposed to be located within unit #102 of the subject shopping plaza and that attendance at such a learning centre is typically for short periods of time after regular school hours and on weekends. It was indicated that, through discussions with the applicant, appropriate safety measures would be utilized in order to ensure the safety of elementary aged students. Council was advised that both the Building and Fire Departments expressed concern with respect to the type of school permitted, and requested that the proposed by-law be worded in such a way as to restrict a larger, full-time school such as a Montessori School. Council was also advised that the Public Works Department requested that third reading of the by-law be held pending the conveyance of two daylighting triangles to the Town, one of which was previously required but never conveyed. In conclusion, Mr. Kyle indicated that Staff was of the opinion that the proposed learning centre was a suitable use within the existing plaza and that a site specific by-law be written to permit this type of use but restrict a school where students attend full-time and would require drop off and play areas. Applicant’s Comments Mr. J. Bousfield, the applicant, indicated that he concurred with the recommendation noted in the Staff Report. He stated that Sylvan Learning Centres did not define themselves as a school and suggested that the proposed use would be complementary to the plaza in that the shopping facilities may be utilized by waiting parents/guardians. In response to questions by Council, Ms. Christie Duncan, proposed owner of the subject learning centre, indicated that security measures such as policy forms signed by the parents/guardians, a staff person responsible for pick up, and a note requirement for alternate pick up arrangements, were in place in order to ensure the safety of younger students. Public Comments Mr. John Armstrong, a nearby resident, expressed his support of the application. The public portion of the meeting closed at 7:47 p.m. and Council’s deliberations began. #152. Moved by Councillor Healy Seconded by Councillor Hartwell Special Council – Public Planning Minutes No. 07-99 Page 3 Thursday, February 25, 1999 THAT staff be directed to prepare an implementing site specific bill to be brought forward to the next available Council meeting for first and second reading; and THAT third reading of the bill not be provided until the required daylighting triangles are provided to the Town of Aurora.
