THAT the content of the Agenda be approved as outlined herein with
the addition of an in camera personal matter.

Mayor Jones advised that this meeting had been called as a Public Meeting with
respect to the proposed Official Plan and Zoning By-law amendment Applications and
amendment to Draft Plan of Subdivision for Bayview Business Park Inc., Lots 82, 83
& 84, Concession I, West side of Bayview Avenue, south of Hollandview Trail, north
of Hollidge Boulevard, application numbers D09-02-97, D14-12-97 and D12-88100;
and proposed Zoning By-law amendment for Canopy Development Corporation, Lots
15 & 16, Plan 107, 61 Centre Street, application number D 14-13-97.
The Public Meeting procedures and the opportunities available for persons to ask
questions related to the items tabled for consideration were explained. Mayor Jones
advised that any person who wished further notice of the passage of the proposed
By-law under consideration could sign the information forms available. In addition,
Mayor Jones advised that any concerns with the proposal must be expressed during
the Public Meeting or in writing prior to the adoption by Council of any amendment
in order to protect the right to appeal to either the Region or the Ontario Municipal
Board. Names and addresses of speakers are required as a part of the record of the
proceedings.

The Clerk advised that the required Notices of Meeting for Applications 009-02-97/
014-12-97; and 014-13-97 were mailed, as well as published in the Era Banner, on
August 5, 1997. The notices were circulated in compliance with the Planning Act,
by First Class Mail, to the addresses within 120 metres of the area shown on the last
revised assessment roll of the Town of Aurora to which the proposed By-law would
apply and to every person within 120 metres who provided the Clerk with written
notice of change of ownership or occupancy and to every person and public body
who provided a written request for such notice. In addition, the necessary signs were
posted on the properties .in accordance with the rules of procedure under the Planning
Act.

Ms. Sarah Henstock, Planner, provided a brief overview of the proposal. The subject
lands are within Phase Ill of the Bayview Wellington draft plan of subdivision. The
subject subdivision was granted draft plan approval by the Region of York in
September of 1994 and designated through the Bayview Wellington Secondary Plan,
approved the Minister of Municipal Affairs and Housing on June 23, 1994. The
applicant has proposed amendments to allow a mix of townhouse, quadruplex, and
semi-detached units, a change to the location of the park block and minor revisions
to the boundary of the neighbourhood commercial block. In order to accommodate
the proposed changes, an Official Plan Amendment and rezoning are required to
change the permitted land use classification and zone standards, and a revision to the
approved draft plan of subdivision is required to accommodate the proposed changes
. and housekeeping changes for Phases I and II. The Planner indicated that while staff
were not opposed to the general principle of reducing the number of units in the
overall Bayview Wellington community, certain design issues are required to be
addressed. These issues include the provision of a landscape buffer strip along
Bayview Avenue, pedestrian linkages between commercial and residential
development, park block and road configurations, and the number of access points
on Hollandview Trail. In conclusion the Planner indicated that the intent of the
Bayview Wellington development was to create a cohesive pedestrian oriented
community with an integrated variety of housing types and densities, institutional,
community and commercial uses. The overall concept as expressed in the Bayview
Wellington Centre Secondary Plan included a community core area comprised of
mixed use higher density residential building framing the Civic Square and connecting
with the community commercial centre. Major changes to the Community Core Area
would change the overall community structure. Council was therefore advised that
should the applications be approved, staff be directed to work with the applicants
toward resolving the issues identified in the Staff Report and that Council continue
to endorse the Community Core concept as set out in the Bayview Wellington Centre
Secondary Plan.
Applicant's Comments
Mr. Boger Beaman, Counsel for the applicant, indicated that he was in support of the
Staff Report and looked forward to working with Staff to address the issues
identified.

Public Comments
A number of residents in the vicinity provided Council with concerns including an
increase in the amount of commercial land use planned for the area and possible
resultant affects on Phase IV of the subject subdivision.
In response to these concerns, planning staff advised that the proposal slightly
reduced the amount of commercial land use planned for the area and that the
proposed amendments would not affect Phase IV. The planned land uses and zoning
in that phase were outlined.
The public portion of the meeting closed at 7:55 p.m. and Council's deliberations
began.

THAT Staff be directed to work with the applicants toward resolving the
issues identified in the Staff Report and report back to Council; and
THAT Council continue to support the goals and objectives of .the
Bayview Wellington Centre Secondary Plan of creating a higher density,
multi-use urban centre providing employment, shopping and recreational
opportunities and a high quality residential neighbourhood including the
maintenance of higher density mixed use buildings in the Community
Core Area adjacent to the civic square.

Mr. Rob Hughes, Planner, provided Council with an overview of the subject
application. The applicant proposes to rezone the property from "Special Mixed
Density Residential (R5) Zone to "Row Dwelling Residential (R6-35) Exception Zone".
The purpose of the amendment is to allow for the construction of a four unit free hold
rowhouse block, each unit having a minimum frontage of 7.0 m• (23.0 ft.') and lot
areas ranging from 186.9 m 2 (2,012 ft2 ) to 295.90 m 2 (3, 175 ft.'). The planner
indicated that the subject land is currently vacant following a fire which destroyed a
six unit rental building. The proposal is similar in concept to the Diamon'd
development located nearby at the southwest corner of Centre street and Walton
Street which is also a small rowhouse design incorporating architectural heritage
features of the surrounding area. Although similar, a separate zoning category was
suggested in order to recognize slight variations reflected in the subject development.
Council was advised that staff recommended that the application be subject to site
plan approval prior to the adoption of an implementing by-law in order deal with
matters such as building elevation design, landscaping, servicing, and the dedication
of a daylighting triangle. Staff also advised Council that the applicant should provide
confirmation to the Town of clear title to the right-of-way as noted on the submitted
survey plans. The planner concluded that Staff had no objections to the proposed ·
application .and suggested that the application be granted subject to the processing
of a site plan application.
Applicant's Comments
Mr. Kim Philip, agent for the applicants, indicated that he was in support of the Staff
Report as presented and had nothing further to add.

Public Comments
Mr. William Partridge of 66 Wellington Street East indicated that he had rights over the
right-of-way noted in the Staff Report of which he had no intention of relinquishing.
One other resident in the vicinity expressed concern with respect to the potential for
increased parking on the street and safety related issues.
In response to the question of parking facilities, Mr. Philip indicated that each of the
proposed townhomes would have a one car garage and a driveway which could
accommodate an additional car, therefore reducing parking on the street.
The public portion of the meeting closed at 8:12 p.m. and Council's deliberations
began.
