Mayor. Jones advised that this meeting had been called as a Public Meeting with
respect to the proposed Official Plan amendment Application for 790216 Ontario Inc.
(Vandorf Road Partnership), Part Lot 16, Concession 3, application number D14-10-
97.
The Public Meeting procedures and the opportunities available for persons to ask
questions related to the items tabled for consideration were explained. Mayor Jon~s
advised that any person who wished further notice of the passage of the proposed
By-law under consideration could sign the information forms available. In addition,
Mayor Jones advised that any concerns with the proposal must be expressed during
the Public Meeting or in writing prior to the adoption by Council of any amendment
in order to protect the right to appeal to either the Region or the Ontario Municipal
Board. Names and addresses of speakers are required as a part of the record of the
proceedings.

The Clerk advised that the required Notices of Meeting for Application 014-10-97
were mailed on June 2, 1997. The notices were circulated in compliance with the
Planning Act, by First Class Mail, to the addresses within 120 metres of the area
shown on the last revised assessment roll of the Town of Aurora to which the
proposed By-law would apply and to every person within 120 metres who provided
the Clerk with written notice of change of ownership or occupancy and to every
person and public body who provided a written request for such notice. In addition,
the necessary signs were posted on the properties in accordance with the rules of
procedure under the Planning Act.
PLANNING APPLICATIONS

Mr. Bruce Hoppe, Planner, provided a brief overview and history of the proposal. The
applicants have requested ari amendment to Zoning By-law 2213-78 affecting the
subject lands to rezone the property from "Rural General (RU) Zone" to a site specific
"Rural Residential (RR) Exception Zone" to permit the creation of three lots each
having a minimum lot area of 2.5 hectares (6.2 acres), a minimum lot frontage of 70
metres (230ft.) and a restriction that no building shall be permitted within 30 metres
(98.4 ft.) of the east branch of the Holland River. The Planner indicated that in 1992
Council considered applications for Official Plan and Zoning By-law amendments
which proposed to subdivide the subject property into 10 estate residential lots with
an internal access road. These applications were refused and subsequently appealed
to the Ontario Municipal Board by the applicants where no action has been taken to
date. It was also indicated that Official Plan Amendment No. 17, adopted by Council
in 1996, places the subject lands within a Rural policy area which restricts
development due to environmental constraints. However, limited residential
development may be permitted on the basis of clustering, communal servicing and
condominium ownership. The proponents have suggested that this is currently not an
economically viable option for the development of this site. The planner informed
Council that the Committee of Adjustment, at its hearing of June 12, 1997,
conditionally' approved related consent applications which would serve to create the
intended lot division of the limds. All three lots are proposed to have access directly
on. Vandorf Side road and . the · dwellings are to be located such that the
environmentally sensitive area of the property to the north is not altered in any
fashion. With respect to the affect on the Oak Ridges Moraine, Planning Staff
suggested that the function of the moraine would not be eroded as a result of the
limited development proposed.
The Planner advised Council that Staff had no objections in principle to the proposal
and concluded that the intent of the Official Plan is maintained, and the proposed
development would appear to form a reasonable and compatible land use for the
property.

Mr. Gary Templeton, agent for the applicant indicated that he was in support of the
Staff Report as presented and had nothing further to add. In response to questions
by Council regarding the previously expressed concerns of a nearby resident, Mr.
Templeton indicated that he had spoken to Mr. and Mrs. Stauffer and assured them

the related Committee of Adjustment decision requiring approval of the Lake Simcoe
Region Conservation Authority.
Public Comments
No members of the public were present to address this application. The public portion
of the meeting closed at 7:15 p.m. and Council's deliberations began.

THAT staff be directed to draft an implementing Bill to rezone the subject
lands to a site spe.cific rural residential zone, with special provisions as
follows:
o a minimum lot area of 2.5 hectares (6.2 acres);
o a minimum lot frontage of 70 metres (230ft.); and,
o a minimum setback of 30 metres (98.4 ft.) from the East Branch
of the Holland River.
