MINUTES - Special Council - 19931101TOWN OF AURORA SPECIAL COUNCIL MEETING NO. 33-93 Council Chambers Aurora Town Hall Monday, November 1, 1993 8:39p.m. I MINUTES --I COUNCIL MEMBERS IN ATTENDANCE Mayor West in the Chair; Councillors Constable; Griffith, Healy, Jones, McKenzie, Pedersen and Timpson. Councillor Weller was absent on vacation. STAFF MEMBERS IN ATTENDANCE Municipal Clerk, Deputy Clerk, Director of Planning and Director of Building Administration. DECLARATION OF CONFLICT OF INTEREST There were no disclosures of interest under the Municipal Conflict of Interest Act. APPROVAL OF AGENDA #620. Moved by Councillor Pedersen Seconded by Councillor McKenzie THAT the content of the Agenda be approved as outlined herein, with the addition of the requests for delegation status from Starline Entertainment Centre Inc. and from Henry and Leah Klein and with the addition of correspondence from Mr. Major, Ministry of Consumer and Commercial Relations for consideration along with Report CL93-042-332. CARRIED Aurora Special Council Minutes No. 33-93 Page 2 Monday, November 1, 1993 DELEGATIONS Starline Entertainment Centre Inc. re: Authorization to Issue Lottery Licences Mr. Chalmers, solicitor for Starline, indicated that his client has been in business for three and one half years in Aurora. During this time it has served community sponsors well, generating approximately $2,000,000.00 for charitable purposes. Now Starline is caught in an unfair circumstance due to the timing of two different provincial enactments. One is the 1989 Order in Council, setting in place a moratorium prohibiting the opening of new bingo halls except under certain limited circumstances. Because of the Order, Starline was no longer in a position to maintain its Class A licence when the premises at 215 Edward Street was sold and Starline's lease was terminated. In this regard, Mr. Chalmers confirmed that the letter from Mr. Major provides that Starline is no longer entitled to provide any goods or services as described under the Gaming Services Act from any location in Aurora. The unfairness results from the fact that the Ministry lifted the moratorium on October 27, 1993, just six days after Starline's request to relocate was not approved and a Class A licence was issued to the new hall owner. Because of this circumstance, Mr. Chalmers requested Council, in considering the recommendation in Report CL93-042-332, to add language to indicate to Starline that it was encouraged to apply for a Class A licence under the new regulations pertaining to the opening of bingo halls. #621. Aurora Bingo Centre and 1032131 Ontario lnc.re: Authorization to Issue Lottery Licences Mrs. Klein introduced herself and her husband as representatives of the Class A licensee and owner of 215 Edward Street. She reviewed their background as successful managers of bingo halls at Jane and Highway No. 7 and at Runnymede and St. Clair. She noted that their goals in Aurora include developing the hall into a landmark for the Town. To this end they have embarked upon a $150,000.00 renovation program and upon an ad campaign geared at a start date of November 5, 1993. She met with all the sponsors on October 27, 1993 and she noted that the sponsors and the bingo patrons generally are eager to have continuity at the bingo hall. Accordingly, she urged Council to permit the bingo hall to open. She noted that they purchased the building and their license in good faith and she looked forward to working with the Town in the provision of lotteries at 215 Edward Street. In response to questions from Council, she noted that she and her husband, in addition to being the managers, personally have purchased a 10% interest in the numbered corporation that owns the premises and the Class A licence. #622. Ministry of Consumer and Commercial Relations re: Starline Entertainment Inc. #623. BY-LAWS #624. Moved by Councillor Griffith Seconded by Councillor Jones THAT Council authorize Staff to continue to licence applicants for lottery licences to conduct bingo lotteries at 21 5 Edward Street; THAT, should Starline Entertainment Centre Inc. comply with Ministry criteria for Class C licencees, Staff be authorized to license a limited range of applicants from the venue selected; and THAT Starline Entertainment Centre Inc. be encouraged to apply for a Class A licence pursuant to the guidelines and criteria to be imposed by the Ministry of Consumer and Commercial Relations. CARRIED Moved by Councillor McKenzie Seconded by Councillor Pedersen THAT leave be given the Mover and Seconder to introduce the following by-law for Third Reading: 3500-93 Being a By-law to amend Sign By-law No. 3400-92 with respect to signs for the sale of subdivision lots.
