BYLAW - Govern Procedures Council Committees Amend 4835 06C - 20110510 - 533511THE CORPORATION OF THE TOWN OF AURORA By-law Number 5335-11 BEING A BY-LAW to amend By-law Number 4835-06. C to govem the procedures of the Council of the Town of Aurora and its Committees and Boards (as amended). WHEREAS subsection 238(2) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that every municipality and local board shall pass a procedure by- law for governing the calling, place and proceedings of meetings; AND WHEREAS on August 22, 2006, the Council of The Corporation of the Town of Aurora ("Council') passed By-law Number 4835-06.0 to govern the procedures of the Council of The Corporation of the Town of Aurora and its Committees and Boards (the "By-law"); AND WHEREAS Council previously amended the By-law with By-law Numbers 4912- 07.C, 4978-07.C, 5057-08.0 and 5300-11; AND WHEREAS Council at its meeting held April 26, 2011, passed a resolution that the Clerk bring forward an amendment to the By-law to provide that recorded votes be conducted randomly; AND WHEREAS Council desires to further amend the By-law in this regard. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF AURORA ENACTS AS FOLLOWS: 1. THAT subsection 5.4 (f) of the By-law be and is hereby deleted and replaced with the following: (f) Where a vote is to be taken for any purpose, a Member may request that the vote be recorded immediately before or after the taking of the vote, but prior to any consideration of another matter of Council, and each Member present, except a Member who is disqualified from voting by statute, shall announce their vote openly, and any failure to vote by a Member who is not disqualified, shall be deemed to be a negative vote. Members shall vote in a random order according to a random selection method determined by the Clerk. The Clerk shall record each vote and announce the results. 2. THAT all other provisions of the By-law, including any amendments thereto, shall remain in full force and effect. 3. THAT this By-law shall come into full force and effect on the date of final passage hereof. READ A FIRST AND SECOND TIME THIS 10th DAY OF MAY, 2011.
