Mayor West advised that this meeting had been called as a Public Meeting with regard
to the proposed rezoning amendment by Gail Ruggles Foster, Lot 10, Plan 439,
municipally known as 37 Harriman Road, Application No. D14-01-93.
The Public Meeting procedure and the opportunities available for concerned residents to
ask questions of the proponent of the application scheduled for consideration was
explained.
Mayor West advised that any person who wished further notice of the passage of the
proposed By-law under consideration could sign the forms available.
The Municipal Clerk advised that the required Notice of Meeting for this application was
mailed on March 1, 1993, in compliance with the Planning Act, by First Class Mail, to
the addresses within 120 metres of the area shown on the last revised assessment roll of
the Town of Aurora to which the proposed By-law would apply. The necessary signs
were posted on the property in accordance with the rules of procedure under the Planning
Act.
DECLARATION OF CONFLICT OF INTEREST
There were no disclosures of interest under the Municipal Conflict of Interest Act.

PLANNING APPLICATION
PL93-021-074-Proposed Zoning By-law Amendment.
Lot 10. Registered Plan 439. 37 Harriman Road.

The Director of Planning showed Council a brief video detailing the area of the subject
lands and provided a overview of this application. The proposal would rezone the lands
from "Detached Dwelling Second Density Residential (R2) Zone" and Environmental
Protection (E.P.) Zone" to "Detached Dwelling Second Density Residential (R2) Zone"
and a site specific "Environmental Protection (E.P.) Exception Zone", in order to
recognize the existing residential use and structures located within the floodplain.
The Director of Planning explained that when the existing dwelling was constructed some
33 years ago, the front yard setback did not comply with the requirements of the zoning
by-law in force at the time. By-law 2213-78 subsequently zoned the lands R2 and E.P.
The E.P. zone, which encompasses the dwelling and accessory structure, does not permit
residential use or structures of any kind. Hence, the applicant submitted a request to the
Committee of Adjustment for a minor variance. However, as the existing E.P. zone does
not allow any buildings there were no setbacks to vary and, accordingly, it was
determined that a rezoning would be required to legalize the dwelling. The Director of
Planning indicated that this amendment is merely administrative in nature in order to
recognize the existing residential use and dwelling located within the floodplain and does
not entail building additions or other alterations to this site. Reconstruction of the
existing building or further encroachments into the floodplain would require further
rezoning and review by the appropriate agencies.
Although a number of enquiries have been received with respect to this proposal, no
objections by agencies or the public have been identified.
Public's Comments
No comments or concerns were expressed by members of the public.
The Public Meeting closed and Council's deliberations began.

THAT approval be granted,. and that the E.P. exception zone recognize
only those structures existing as of the date of passing of the amending By-
law.
