MINUTES - Special Council - 19840426(_:_ ____ , MINUTES OF THE SPECIAL COUNCIL MEETING HELD IN THE BOARD ROOM AT THE YORK REGION BOARD OF EDUCATION, THURSDAY, APRIL 26th, 1984 AT 7:30 P.M. Present Were: Mayor Illingworth and Councillors Richard Barker, Evelyn Buck, Len Ostick, Martin Paivio (8:15 p.m.}, and Norm Stewart. Absent Were: Councillor West absent due to illness, Councillor Jones absent due to employment commitment and Councillor Earl Stewart on vacation. Also in attendance were Deputy Clerk C.E. Gowan and Regional PlannerS. Seibert. Mayor Illingworth advised that this was "Volunteer Week" and that the Town of Aurora is indebted to the many volunteers in so many fields, who help to make Aurora a better community in which to live. Mayor Illingworth advised those present that this meeting has been called as a Public Meeting with respect to the introduction of By-Laws amending the Zoning By-Law for Markborough Properties Limited, and Official Plan Amendments for Robert Kelly, Sr. and Addington Place and other Council matters. Deputy Clerk C.E. Gowan advised that Notices of the Meeting were mailed on March 15th, 1984, by first class mail, to addresses within 120 metres of the areas, as shown on the last revised Assessment Roll of the Town of Aurora, to which the By-Laws would apply and further, the necessary signs were posted on the various properties in accordance with the rules of procedure under The Planning Act (1983). Mayor Illingworth advised that any persons who wished further notice of the passage of any of the By-Laws under consideration should sign the forms available before they leave this meeting. Mayor Illingworth requested PlannerS. Seibert to outline Application Number Z-15-84 (Markborough). Proposal (Markborough Properties Limited} The subject property is located on the east side of Yonge Street, north of Mark Street and south of Valhalla Court. The applicant proposes to re-zone the subject property which has a frontage of 165 metres (541 feet) and an area of approximately 1 hectare (2.5 acres) from "Holding" to "C4-Shopping Centre Commercial" and "C2 -Central Commercial" to permit a shopping centre on the site. The plans submitted in support of the proposal indicate two (2) 445m2 (26,000 square feet) of floor area located in two buildings, the more southerly of which would have two (2) stories. Comment The applicants have applied for both "C2" and "C4" zoning. The "C2" zoning is intended to apply to the Central Business Area. It is therefore not considered appropriate that this site be zoned "C2". In respect to the "C4" zoning requested, it is suggested that some limitations should be placed on the permitted uses. In August of 1981 a public meeting was held concerning the Official Plan Amendment on this subject site. Apparently at that time, commitments were made by Council that no restaurants would be permitted on the subject site. The Official Plan Amendment therefore contained a policy statement which indicated as follows: "Council will carefully review any proposed development on the site in order to insure that the proposed uses, the massing and design of the proposal are compatible with and complimentary to the nearby residential uses, built forms and the Yonge Street streetscape." This clause was made part of the Amendment to allow Council to control the uses permitted by the Zoning By-Law. It is suggested that if the public and Council are still concerned with uses such as a restaurant on this site, the use not be permitted in the "C4" zoning applied to this site. SPECIAL COUNCIL MEETING ••• THURSDAY, APRIL 26th, 1984 - 2 - Agency Comments South Lake Simcoe Conservation Authority has no objection. Other Comments Suncor-express concern that the "C4" zoning permits a gasoline use. Concerns of Residents -traffic problems -noise -hours of businesses -type of fencing to be used -residents would 1 ike to see this area contain professional offices Ostick: Barker: Resolved that this application (Z-15-84) be referred to the Planning Committee for a report. CARRIED Councillor Paivio declared a possible Conflict of Interest in Application Number OP-16-84 (Kelly) due to contractual interest and did not take part in the consideration of or vote on any question in this regard or attempt in any way to influence the voting on such question. Mayor Illingworth requested the Planner to outline Application Number OP-16-84 (Kelly). Proposal (Mr: R. Kelly) The subject property is located on the east side of Old Yonge Street as shown on the attached plan. The applicants have proposed to redesignate the property which has approximately 41 metres (135 feet) of frontage and 245 metres (800 feet) of depth with an area of approximately 1 hectare (2.5 acres) from "Rural" to "Urban Residential". No plan or proposed uses have been submitted in support of the application. Comment The subject property is surrounded by properties which are designated from "Rural" land uses in the Official Plan. In addition, the linear shape of the property makes it difficult to develop. Because, ultimately, this area will be serviced with both municipal services and water, the property has been included within the urban servicing boundary. If any Official Plan Amendment is to take place it should encompass the area up to St. John's Sideroad. Since the area also forms a transition from urban to rural, it is suggested that the types of densities permissible should be examined for this area. To this end it is suggested that the proposal be referred to Planning Committee for report and recommendation. Agency Comments Received South Lake Simcoe Conservation Authority has no objection. Concerns Expressed by Residents -traffic There were two residents present who were in favour of the proposal. Buck: Barker: Resolved that the recommendation of the Planner be accepted and this proposal be referred to the Planning Committee for a report. CARRIED SPECIAL COUNCIL ... THURSDAY, APRIL 26th, 1984 - 3 - Mayor Illingworth request Mrs. Seibert to outline Application Number OP-17-84 (Addington Place Inc.). Proposal (Addington Place Inc.) The subject site is an irregularly shaped property having interrupted frontage on Bathurst Street south of Henderson Drive. The property comprises 62 hectares (154 acres). The applicant proposes to amend the official plan category from "Rural" to "Estate Residential". Comment The subject property is located within an area which has been under considerable pressure for development for residential purposes. The property is bounded on the west by a major regiona 1 road and on the east, in part, by property held for development purposes. Because of the pressure to redesignate this and other land within the quadrant from "Rural" to "Residential" uses, Council have taken the position that a Secondary Study of the area should be undertaken. The purpose of that study would be to determine appropriate land uses, road patterns, treatment adjacent to major roads among other things. It is suggested that no action be taken on this application until that study is underway and the major pol icy decisions have been made. Agency Comments South Lake Simcoe Conservation Authority -recommends that proposed Official Plan Amendment not be approved until the proponents submit a satisfactory hydrogeological report to the Conservation Authority to ensure the site is suitable for development. Ministry of Agriculture and Food-have no concerns in principle with the proposal but express concern with the existence of an active dairy farm to the west of the subject site. This site contains 2 barns and a corn dryer. Concerns of Residents -buffer between properties -would like to see a detailed plan of green belt area Buck: N. Stewart: RESOLUTIONS Resolved that no action be taken on this application (Addington Place) until the Secondary Study area is underway and the major policy decisions have been made. CARRIED 1. Red Shield Month -May N. Stewart: Buck: Resolved that the month of May be proclaimed Red Shield month in the Town of Aurora and the Red Shield flag be flown at the Administrative Centre. CARRIED 2. Retrofit Program N. Stewart: Buck: Resolved that the Aurora Fire Department undertake an inspection of all town owned buildings so a program of compliance with Part 9 (Retrofit) of the Fire Code can be implemented. CARRIED 4. Annual Carnival -Aurora Lions Club Buck: N. Stewart: Ostick: Paivio: Resolved that the Aurora Lions Club be granted permission to hold their Annual Carnival in the Town Park on May 4th, 5th and 6th, 1984, Be It Further Resolved that the Lions Club be responsible for any damage caused to the Park due to early usage. CARRIED Resolved that the 72-hour Notice of Meeting be waived and the following matter be discussed. CARRIED 5. Lakeview Sales Trailer N. Stewart: Barker: N. Stewart: Barker: ADJOURNMENT N. Stewart: Resolved that the resolution pertaining to the relocation of the Lakeview Estates Sales trailer be reconsidered at this time. CARRIED Resolved that the resolution pertaining to the relocation of the Lakeview Estates Sales trailer be rescinded due to zoning problems, Be It Further Resolved that Lakeview Estates be advised that Council will offer assistance in finding another location for this sales trailer.
