PLANNING liND DEVELOPMENT COMMITTEE REPORT NO. 16?
Councillor Harris presented a report· of the Planning and Development Committee
in which the Committee respectfully submitted the following:
A meeting of the Planning and Development Committee was held on Tuesdey,
22nd. of February 1972, at 8:00 p.m.
Present were: CouncilloJ-s I. Harris and E. Henderson-: R. Hunter, R. Harrington
and c. Dlqlean
The Committee reviewed in detail, letters 3-50 and 3-83 and Report No, 159 of
the Committee of Adjustment.
The Committee of Adjustment has granted a severance of a parcel of land for
Mr. S~ Burnett ·on the east side of Bayview Avenue, part of lot 21, Concession
2, having a frontage of 125 feet and a lot area of 25,000 sq. ft. Thehst
date for appeal is February 2811!, 1972·
In the decision, the Committee of Adjustment stated as a reason for the decision
that no objection, written or verbal, was received by the Committee of Adjustment.
The Planning Committee has duly noted letter ~3 sent to Mr. Dinsmore on
January 2611!, 1972 by the Building Inspector outlining his reasons for not
granting approval of the severance -as follows:
(a) A Zoning By-law amendment and a re-zoning to a Residential Rural Estate
category is mandatory. '1 :
(b) A minimum lot area of 2 acres, and minimum frontage of 200 1 would be
required.
(c) As the former Township of Whitchurch Zoning By-law #2083, adopted by the
Town of Aurora, has been extended to February 2911!, 1972, and since O,P.
Amendment #1 has been approved by the Regional Council (but not by D.M.A.)
the criteria as contained therin should be maintained especially sections
4.2.4, 4.2.6., and 4.2.7. of the Official Plan.
The Committee strongly feels that the minimum lot area considered for this
severance should have been two acres to ensure obtaining a building permit
and therefore recommends that the Coufl.eil appeal the decis:iQn of the Committee

of Adjustment as the parcel to be severed does not conform to the requirements
of the Whitchurch Official Plan and By•law No. 2083.

"Resolved that the previous resolutions, passed by the Council
at the Regular Meeting held on February 21st, 1972 to accept
the Committee of Adjustment Reports No. 159 and No. 163 in
which the Council did not object to the Committees decision
on Submission No. B2/72 (B-53) and-No. B4/72 (B-55), be
rescinded and that an_appeal be made of both decisions of the
Committee of Adjustrumt•"
