BYLAW - Appoint Deputy Mayor John Abel - 20101214 - 529510`WHEREAS section 242 of the Municipal Act, 2001, S.O.2001, c. 25, as amended (the
"Act'), provides that a municipality may, by by-law or resolution, appoint a member of
the council to act in the place of the head of council or other member of council
designated to preside at meetings. in the municipality's procedure by-law when the head
of council or designated member is absent or refuses to act or the office is vacant, and
while acting such member has all the powers and duties of the head of council or
designated member, as the case may be;,
AND WHEREAS section 4.3 of the Town's Procedural By-law Number 4835-06.C, as
amended, provides that the Council shall appoint by By-law the Member who received
the highest number of votes to be elected to act in the place and stead of the Mayor
when the Mayor is absent from the municipality, or is absent through illness, or refuses
to act, or the office is vacant. Such appointee shall be known as the Deputy Mayor and
shall have all of the duties, rights, powers and authority of the Mayor during such
Absence, refusal to act, or vacancy of office; .
AND WHEREAS the Town Clerk has certified that John Abel is the Member who
received the highest number of votes;
AND WHEREAS the Council of The Corporation of the Town of Aurora deems it
necessary and expedient to appoint John Abel as Deputy Mayor;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
AURORA ENACTS AS FOLLOWS:
1. THAT Councillor John Abel be and is hereby appointed as the Deputy Mayor
(Acting Head of Council) to act from time to time in the place of Mayor Geoffrey
Dawe, where Mayor Geoffrey Dawe is absent; refuses to act, or the office is
vacant, in accordance with the provisions set -out in section 242 of the Act and
the Town's Procedural By-law Number 4835-06.C, as amended.
2. THAT By-law 4874-06.0 be and is hereby repealed.
