BYLAW - ZBA 15387 Yonge Street - 20100713 - 526210THE CORPORATION OF THE TOWN OF AURORA By-law Number 5262-10 BEING A BY-LAW to amend Zoning By-law No. 2213-78, as amended (15387 Yonge Street). WHEREAS section 34 of the Planning Act, R.S.O. 1990, c. P.13, as amended, provides that the councils of local municipalities may pass zoning by-laws; AND WHEREAS the Council of The Corporation of the Town of Aurora (hereinafter the "Town") enacted By-law 2213778, including amendments thereto (hereinafter the "Zoning By-law"); AND WHEREAS the Council of the Town enacted By-law 2912-87, which amended the Zoning By-law to rezone the lands shown in hatching on Schedule "A" attached hereto and forming part of this By-law to "Special Mixed Density Residential (R5-12) Exception Zone and to provide provisions respecting the said zoning (hereinafter the "Site Specific By-law"); AND WHEREAS the Council of the Town enacted By-law 4652-05.D, which amended the Zoning By-law to delete and replace Section 14.3.11 which was originally added by the Site Specific By-law entitled "Special Mixed Density Residential (R5-12) Exception Zone; AND WHEREAS the Council of The Corporation of the Town of Aurora deems it necessary and expedient to further amend the Zoning Bylaw and to replace By-law 4652-05.D and the Site Specific By-law with the terms and provisions set out below; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF AURORA HEREBY ENACTS AS FOLLOWS: 1. THAT the Zoning By-law is hereby amended to delete the contents of Section 14.3.11 entitled "Special Mixed Density Residential (R5-12) Exception Zone" applying to the lands shown in hatching on Schedule "A" attached hereto and replace the contents of that Section with the following: 14.3.11.1 14.3.11.2 14.3.11.3 Uses Permitted The following uses shall be permitted: - business and professional offices, excluding medical offices and retail stores; - limited retail uses having a maximum gross floor area of 30 m2; - personal service shops; - art galleries; and, - studios. Lot Specifications Lot Area (minimum) Lot Frontage (minimum) Siting Specifications Front yard (minimum) Rear yard (minimum) Interior side yard (minimum) North Side 800 square metres 15 metres 4.5 metres 7.5 metres 4.0 metres By-law 6262-10 Page 2 of 3 - South Side 2.0 metres Notwithstanding the provisions of Section 6.48.1, open sided roofed porches, steps and landings may project a maximum of 1.0 metre into the. required south interior side yard and 1.9 metres into the minimum front yard. 14.3.11.4 Building Specifications Height (maximum): 10.0 metres Lot Coverage (maximum) 35.0 percent 14.3.11.5 Parking Notwithstanding the provisions of Section 6.26.1, parking shall be calculated at a minimum parking rate of 5.4 spaces for each 100 mZ of commercial floor area. The subject property and the abutting property to the north zoned "Special Mixed Density Residential (R5-5) Exception Zone" may have a shared parking lot. 14.3.11.6 Ingress and Egress Notwithstanding the provisions of Section 6.27.8(a) the minimum driveway width shall be 3.30 metres. The subject property and the abutting property to the north zoned "Special Mixed Density Residential (R5-5) Exception Zone" may have a shared driveway with a maximum width of 10.0 metres. 14.3.11.7 Buffer Strip The Buffer Strip requirement of Section 6.31 shall not apply along the north lot line. Notwithstanding the provisions of Section 6.31.2(ii), a chain link fence or wood fence of a minimum height of 1.5 metres shall be permitted along the east lot line. 2. THAT By-laws 4652-05.D and 2912-87 be and are hereby repealed. 3. THAT all other terms, provisions, and existing amendments of the Zoning By- law remain the same and are hereby reaffirmed. 4. THAT the provisions of this By-law shall come into force and take effect upon third reading subject to compliance with the provisions of the Planning Act, R.S.O. 1990, c. P. 13, as amended.
