MINUTES - Council - 20110927 TOWN OF AURORA COUNCIL MEETING MINUTES Council Chambers Aurora Town Hall Tuesday, September 27, 2011 ATTENDANCE COUNCIL MEMBERS Mayor Dawe in the Chair; Councillors Abel, Ballard, Buck, Gaertner, Gallo, Humfryes, Pirri, and Thompson MEMBERS ABSENT None OTHER ATTENDEES Chief Administrative Officer, Director of Customer and Legislative Services/Town Clerk, Director of Legal Services/Town Solicitor, Director of Building and By- law Services, Director of Parks and Recreation Services, Director of Planning and Development Services, Director of Infrastructure and Environmental Services, Manager of Revenue and Accounting/ Deputy Treasurer, and Council/Committee Secretary Following Open Forum, Mayor Dawe called the meeting to order at 7:02 p.m. I DECLARATIONS OF PECUNIARY INTEREST There were no declarations of pecuniary interest under the Municipal Conflict of Interest Act. II APPROVAL OF AGENDA Moved by Councillor Pirri Seconded by Councillor Abel THAT the agenda as circulated by the Customer and Legislative Services Department, with the following additional item, be approved:  Delegation (a) Tyler Barker, Resident Re: Item 1 (12) – AAC11-05 – Accessibility Advisory Committee Report, September 7, 2011 CARRIED Council Meeting Minutes Tuesday, September 27, 2011 Page 2 of 6 III ADOPTION OF MINUTES Council Meeting Minutes of September 13, 2011 Moved by Councillor Abel Seconded by Councillor Pirri THAT the Council Meeting minutes of September 13, 2011 be adopted as printed and circulated. CARRIED IV PRESENTATIONS None V PUBLIC SERVICE ANNOUNCEMENTS Councillor Gaertner remarked that the plantings at Yonge and Wellington are beautiful and she passed on the many compliments received to Parks and Recreation Services. Councillor Humfryes reminded everyone that the Community Recognition Awards deadline is October 6, 2011, and that information regarding the nine categories for nominations is available on the Town website. Councillor Abel noted that an Aurora-based company called Bottle Bin will be featured on Dragon’s Den on October 5, 2011 and that there is a get-together at Boston Pizza for family and friends during the airing of this segment. Mayor Dawe invited all to participate in the Artist’s Studio Tour this weekend with over 20 artists opening their studio doors to the general public. Mayor Dawe stated that October 3, 2011 is designated as World Habitat Day. VI DETERMINATION OF ITEMS REQUIRING SEPARATE DISCUSSION Items 1(9), 3, and 5 were identified for discussion. VII ADOPTION OF ITEMS NOT REQUIRING SEPARATE DISCUSSION Items 1 (with the exception of subsection 9), 2, and 4 were identified as items not requiring separate discussion. Moved by Councillor Gallo Seconded by Councillor Abel THAT the following recommendations respecting the matters listed as “Items Not Requiring Separate Discussion” be adopted as submitted to Council and staff be authorized to take all necessary action required to give effect to same: 1. General Committee Meeting Minutes of September 20, 2011 THAT the minutes of the General Committee meeting of September 20, 2011 be received and the recommendations carried by the Committee be approved with the exception of subsection 9. Special General Committee Meeting Minutes of September 20, 2011 THAT the minutes of the Special General Committee meeting of September 20, 2011 be received and the recommendations carried by the Committee be approved. 4. Joint Council Committee Meeting, Minutes of June 28, 2011 THAT the minutes of the Central York Fire Services – Joint Council Committee meeting of June 28, 2011 be received for information. CARRIED VIII DELEGATIONS (a) Tyler Barker, Resident Re: Item 1 (12) – AAC11-05 – Accessibility Advisory Committee Report, September 7, 2011 Mr. Barker addressed Council regarding the lack of access to Council Chambers as the existing ramp is too narrow and unstable. He stated that this is an important issue and he understands the cost involved, however, he asked that Council give consideration to accomplishing this in the next year or two. Mr. Barker noted that Aurora is at the forefront in setting many of the standards for accessibility in York Region. Moved by Councillor Abel Seconded by Councillor Ballard THAT the comments of the delegate be received and referred to staff for consideration. CARRIED IX CONSIDERATION OF ITEMS REQUIRING SEPARATE DISCUSSION 1. General Committee Meeting Minutes of September 20, 2011 (9) PR11-039 – Award of Tender PRS2011-70 – Wellington Street – Streetscape Planting Moved by Councillor Ballard Seconded by Councillor Gaertner THAT this Item be deferred for two weeks. DEFEATED Moved by Councillor Buck Seconded by Councillor Humfyres THAT Council receive report PR11-039; and THAT Tender PRS2011-70 – Wellington Street - Streetscape Planting be awarded to Iron Trio Inc. for $465,215.00 plus taxes; and THAT the Mayor and Town Clerk be authorized to execute the necessary Agreement including any and all documents and ancillary agreements required to give effect to same. Deferred from Council meeting of September 13, 2011 (Item 3) CLS11-013 – Council’s Procedural By-law Moved by Councillor Gaertner Seconded by Councillor Ballard THAT section 3.8(b) be excluded from the draft. On a recorded vote, the motion was DEFEATED. YEAS: 3 NAYS: 6 VOTING YEAS: Councillors Abel, Buck, Humfryes, Pirri, Thompson, and Mayor Dawe VOTING NAYS: Councillors Ballard, Gaertner, and Gallo Moved by Councillor Gaertner Seconded by Councillor Ballard THAT the wording in section 4.3 (f) be changed from ”improper conduct at the Meeting” to “improper conduct at that Meeting.” CARRIED Moved by Councillor Gaertner Seconded by Councillor Gallo THAT section 4.3 (f) be added to section 4.1 as 4.1(d). CARRIED Moved by Councillor Thompson Seconded by Councillor Buck THAT section 3.13 (b) be deleted; and THAT the wording in section 3.13 (a) be amended with the addition of “or General Committee Meeting.” DEFEATED Moved by Councillor Abel Seconded by Councillor Thompson THAT the Clerk bring forward a recommendation for a less restrictive section 3.13. CARRIED Moved by Councillor Humfryes Seconded by Councillor Thompson THAT report CLS11-013 be received; and THAT Council approve the recommended revisions to the draft Procedural By-law; and THAT the Clerk be directed to bring forward a By-law to be enacted. O’Neill, Re: Water and Sewer Rates Moved by Councillor Gaertner Seconded by Councillor Ballard THAT Council receive and refer the correspondence regarding Water and Sewer Rates to staff for a report back to Council before the end of November, 2011. CARRIED X NOTICE OF MOTION/MOTIONS FOR WHICH NOTICE HAS BEEN GIVEN (i) Notices of Motion (a) Mayor Dawe Re: Provide General Committee/Council DVD to Aurora Public Library WHEREAS the proceedings of Council should be available to all residents; and WHEREAS the Town does not yet have the capability to provide streaming audio and video feeds. NOW THEREFORE BE IT RESOLVED THAT the Clerk’s office provide a copy of the DVD, of every General Committee and Council meeting, to the Aurora Public Library. XI REGIONAL REPORT None XII NEW BUSINESS/GENERAL INFORMATION – COUNCILLORS Councillor Buck requested a chronology regarding the lease of the former Hydro building to the Department of Defence.
