BEING A BYLAW to
appoint an Integrity
Commissioner,
WHEREAS subsection 5(3) of the Municipal Act, 2001, S;O.2001, c. 25, as amended.
(the °Acf) provides that a municipal power shall be exercised by bylaw unless the
municipality is'specifically authorized to do otherwise;
AND WHEREAS pursuant to subsection 223.2(1) the Act, and without limiting sections
9,10 and 11 of the Act, those sections authorize the municipality to establish codes of
conduct for Members of. Council of the municipality and of local boards of the
municipality;
AND WHEREAS on June 24, 2008, the Council of The Corporation of the Town of
Aurora (the 'Town') passed Bylaw Number 5036-08.0 to formally adopt a Code of
Conduct governing Members of Council;
AND WHEREAS pursuant to subsection 223,3(1) of the Act, and without limiting
sections 9,10 and 11 ofthe Act, those sections authorize the municipality to appoint an
Integrity Commissionerwho reports to Council and who is responsible for performing in
an independent manner the functions assigned by the municipality with respect to:
(a) the application of the code of conduct for Members of Council and the code of
conduct.for members of local boards or either of them;
(b) the application of any procedures, rules and policies of the municipality and local
boards governing the ethical behaviour of Members of Council and of local
boards or of either of them; or
(c) both of (a) and (b) above;
AND WHEREAS subsection 223.3(2) of the Actprovides that, subject to Part V.1 of the
Act, in carrying out the responsibilities described in subsection 223.3(1) of the Act, the
Integrity Commissioner may exercise such powers and shall perform such duties as may
be assigned to him or her by the municipality;
AND WHEREAS, pursuant to Request for Proposal Bid #ADM 2009.93, the Town
invited proposals for the services of an Integrity Commissioner for the Town (the'RFP');
AND WHEREAS at its January 26, 2010 Meeting, Council resolved that the RFP for
Integrity Commissioner services be awarded to David H. Tsubouchi;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
AURORA ENACTS AS FOLLOWS:
1, That David H. Tsubouichi be and is hereby appointed Integrity
Commissioner for the Town, and he shall have the powers conferred
and perform the duties imposed on the Integrity Commissioner as set
out in Part V.9 of the Act
2. That the term of appointment of David H. Tsubouchi as Integrity
Commissioner for the Town is as set out in the RFP; and
3, That this By-law shall come into force and have full effect upon third
reading.
