DECLARATIONS OF INTEREST Mayor Jones declared an interest in certain aspects of Report PL98-096-210 regarding the Planning Application Status List relating to 610645 Ontario Ltd. (Timberlane Tennis Club) due to membership with same and did not take part in or vote on any questions in this regard or attempt in any way to influence the voting on such questions. APPROVAL OF AGENDA #575. Moved by Councillor Hinder Seconded by Councillor Hartwell THAT the content of the Agenda be approved as outlined herein with the addition of delegation requests from Marshall Macklin Monaghan regarding Report PL98-095-214 re: Site Plan Application, Fernbrook Homes (Stonebridge) Limited, and Malone Given Parsons Ltd. regarding Report PL98-091-213 re: Ontario Heritage Foundation Public Information Meeting. CARRIED PRESENTATIONS Councillor Griffith re: Business Award Plaque to the Caruso Family on behalf of the Business Development Committee Councillor Griffith informed Council that the Caruso family owned and operated Mary’s Flower Shop and Mary’s Fruit Store in the downtown Aurora for over 80 years. Mayor Jones on behalf of the Business Development Committee presented the Caruso family with a plaque to recognize their retail service in the downtown core community. ERRATUM M I N U T E S Aurora Council Minutes No. 30-98 Page 2 Wednesday, September 9, 1998 Marion Baggett on behalf of Preceptor Beta Kappa Chapter, Beta Sigma Phi re: Donation to the Wiles Court/Murray Drive Parkette Ms. Marion Baggett, Service Chairperson, Preceptor Beta Kappa Chapter, Beta Sigma Phi presented a cheque in the amount of $500 to Mayor Jones and the Director of Leisure Services for the installation of two benches for the Wiles Court/Murray Drive parkette. She advised that the benches would provide a welcomed pedestrian reststop especially for the residents of the nearby retirement home. Ms. Baggett expressed appreciation to Town staff for their assistance in restoring the benches and planting trees in the parkette. She requested that the large painted Beta Sigma Phi wording be replaced with smaller plaques as originally agreed. Mayor Jones on behalf of the Town thanked Beta Sigma Phi for their ongoing support in the community. DELEGATIONS Jamie Bennett, Marshall Macklin Monaghan Limited re: PL98-095-214 – Site Plan Application, Bayview Vandorf Subdivision Fernbrook Homes (Stonebridge) Limited, South west corner of Bayview Avenue and Vandorf Sideroad; D11-03-98 Mr. Jamie Bennett, planning consultant, on behalf of Fernbrook Homes (Stonebridge) Limited advised Council that the purpose of the Site Plan Agreement to permit the development for the access road and bridge portion of the Fernbrook project is to facilitate construction of the work prior to September 30, 1998, which is the latest date for agency approval of construction within the watercourse. He advised that the requirement for registration of the Phase III M-Plan would negate the possibility of the bridge construction this season which would negatively impact Fernbrook’s construction schedule. Mr. Bennett requested Council approval of the staff recommendation as set out in Report PL98-095-214 that was tabled this evening, with the deletion of the requirement for registration of the Phase III M-Plan on title to the property. He thanked staff for their effort in advancing the development plans. #576. CARRIED Richard Harrison, Malone Given Parsons Ltd. re: PL98-091-213 – Ontario Heritage Foundation- Public Information Meeting Mr. Harrison, consultant for The Ontario Heritage Foundation advised Council that the Foundation became owner of the Anne Bartly Smith property in 1992. He provided an overview of the property located northeast of Bloomington Sideroad and Bathurst Street and explained the nature of the preliminary land dedication boundary. He indicated that the Foundation is proposing to convey the most southerly lands on the site to the Town as open space with a conservation easement registered against the title, under a Parkland Heritage Agreement, and the lands to the north would be sold. Mr. Harrison informed Council that a public meeting/open house would be held with the residents of the neighbourhood on October 7, 1998 at the Highview Public School to informally present their plans for the property. Mr. Harrison advised that they would bring the matter back to Council once they had their meeting with the neighbourhood. #577. STAFF REPORTS CO98-053-205 - Proposed Purchase of Part of Block 48 SECTION “A” – CONSENT ITEMS Aurora Council Minutes No. 30-98 Page 4 Wednesday, September 9, 1998 Registered Plan 65M-3220 (Aurora Gardens Subdivision) THAT Council authorize the conveyance of portions of Block 48, Plan 65M-3220 to the adjoining owners for a purchase price of $19.73 per square metre, plus survey and legal costs, subject to the required land sale notice being advertised in the local newspaper for two weeks and no adverse comments being received thereafter and subject to the satisfaction of Public Works that the developer has completed all required works and stabilized the lands; THAT the Clerk be authorized to introduce a Bill to convey the subject lands; and THAT the Mayor and Clerk be authorized to execute the documents necessary to transfer the lands to the adjoining property owners. PL98-092-207 - Release for Registration of Phase III Part of Lots 74 and 75, Concession 1, E.Y.S. Bayview Vandorf Subdivision Fernbrook Homes (Stonebridge) Limited South west corner of Bayview Avenue and Vandorf Sideroad D12-90054 THAT Council authorize the Mayor and Clerk to execute a Subdivision Agreement dated November 1, 1996 as revised September 9, 1998 between the Town of Aurora and Fernbrook Homes (Stonebridge) Limited, with respect to the lands, as defined within the Agreement, contained within Draft Plan of Subdivision 19T-90054(R) subject to the provision of financial payments and securities, as described in Schedules “F” and “H”; THAT the Mayor and Clerk be authorized to execute all documents necessary to effect the transfer of certain lands, reserves, and easements at the developers expense, as described in Schedule “G” of the Agreement, in particular providing an R-plan for an easement for access and sewers; and THAT upon execution of the Subdivision Agreement, Council allocate the servicing capacity necessary to provide water and sanitary sewers to Phase III of the development which is 100 units of the 173 total dwelling units. PL98-093-208 - Site Plan Application Tennex Systems Inc., 36 Industry Street Lot 9, Registered Plan 535; D11-27-88 THAT Council authorize the Mayor and Clerk to enter into a Site Plan Agreement with Tennex Systems Inc. to permit the construction of an industrial addition comprising approximately 197 square metres (2121 sq.ft.) for lands municipally known as 36 Industry Street. PL98-094-209 - Proposed Official Plan Amendment Old Park Holdings Limited, Part of Lot 80, Concession 1, E.Y.S. Southwest of Wellington Street and Bayview Avenue D09-04-98 THAT Council give third reading to Bill 3978-98.D being a by-law to adopt Official Plan Amendment No. 26. #578. CARRIED STAFF REPORTS CO98-052-211 - Advance Funding Program Update Ontario Lottery Corporation #581. Moved by Councillor Hogg Seconded by Councillor Morris THAT Report CO98-052-211 regarding the update for the Advance Funding Program provided by the province under the Ontario Lottery Corporation be received as information; THAT Staff solicit applications for the Advance Funding Program from local charities and non-profit organizations, clarifying the program details and eligibility and that applications be considered by Council prior to March 31, 1999; THAT Staff liaise with the other area municipalities in York Region regarding the provincial guidelines that have been published for the municipalities to follow when determining advance funding of organizations including local criteria to be developed in order that program funds may be allocated in a consistent manner in York Region; and THAT Staff be directed to prepare the roster of local charities to share in the advance funding and that a further report be submitted for Council's consideration based on the applications received and eligibility for a determination as to the program funding allocation, and that the roster be developed based primarily on local needs and priorities. CARRIED PL98-095-214 - Site Plan Application Part of Lots 74 and 75, Concession 1, E.Y.S. Bayview Vandorf Subdivision Fernbrook Homes (Stonebridge) Limited South west corner of Bayview Avenue and Vandorf Sideroad D11-03-98 and Delegation of Jamie Bennett, Marshall Macklin Monaghan #584. Moved by Councillor Healy Seconded by Councillor McKenzie THAT Council authorize the Mayor and Clerk to enter into a Site Plan Agreement with Fernbrook Homes (Stonebridge) Limited, File D11-03-98, to permit the development of a road and bridge to access Phase III of the Bayview Vandorf Subdivision subject to the payment of all fees and securities; and THAT no permits be issued or any site work commenced for the remainder of the Phase III site of the Bayview Vandorf Subdivision until all issues have been addressed to the satisfaction of the Town of Aurora and a Site Plan Agreement is entered into between the Town and the owner to address the development issues. Moved by Councillor West Seconded by Councillor Healy THAT Council authorize the conveyance of portions of Blocks 34 and 36, Plan 65M-3123 to the adjoining owner, subject to the required land sale notice being advertised in the local newspaper for two weeks and no adverse comments being received thereafter; THAT the Clerk be authorized to introduce a Bill to convey the subject lands; and THAT the Mayor and Clerk be authorized to execute the documents necessary to transfer the lands to the adjoining owner for the value determined in the appraisal. Moved by Councillor West Seconded by Councillor Healy THAT the part of the Planning Applications Status List relating to 420643 Ontario Limited (Senator Homes) be received as information. CARRIED Councillor Morris, having previously declared an interest in certain aspects of Report PL98-096-210 relating to 420643 Ontario Limited (Senator Homes), did not take part in the vote called for in this regard. AND THAT the same be taken as read a Third Time. CARRIED NOTICE OF MOTION Councillor Morris provided a Notice of Motion regarding a review of correspondence and complaint procedures before Council. QUESTIONS BY MEMBERS Councillor Hogg - Asked for an update on the Town of Aurora Strategic Plan. - Enquired about the status of additional information on property taxes and the proposed Aurora Cable TV program on the new property assessment system. - Enquired as to the basis for information recently provided to Council regarding Council and Committee meeting attendance by members. Councillor Morris - Enquired as to the condition of the development site on Yonge Street and Centre Street. - Enquired about the status of the Totera property next to Mac’s Milk on Wellington Street East. - Enquired about the landfill operation on the property at the south end of Town and that some fill is coming close to the hydro lines on Bloomington Road. Councillor Hartwell - Asked for an update on the reconstruction of Yonge Street. Councillor West - Asked staff to investigate the possibility of providing a discount on bus passes for young people when there is more than one bus pass purchased in a family. Councillor Hogg - Asked that Members of Council be updated on current and future road reconstruction projects on a regular basis in order to respond to residents enquiries. Mayor Jones - Advised that the Timberlane Charity Classic, Magna Hoedown, Candle Light Tour for Hilliary House, and Minor Ball Playoffs are being held this weekend and that Members of Council are welcomed to attend.
